Limited liability RisingWebHost cannot be held responsible for: Temporary or permanent unavailability of the service Data loss caused by the user, a third party, or an external attack Consequences of illegal or non-compliant hosted content (the client is solely responsible for the content of their site) Any commercial damage, loss of revenue, or loss of operation
7. User obligations The user agrees to: Not host illegal, defamatory, or infringing content Comply with current Canadian and international legislation Keep their access identifiers confidential
8. Changes to offers We reserve the right to modify our packages, rates, resources, or features without notice, within reasonable limits. Any significant changes will be announced via the client portal or by email.
9. Applicable jurisdiction These terms are governed by the laws in effect in the province of Quebec (Canada). In case of dispute, the courts of the district of Lévis will be the only competent authorities.
10. Payments, billing, and fraud The client agrees that any validated order implies an obligation to pay. Any attempt at fraud, chargeback, or unauthorized payment will result in the immediate suspension of the account without notice. Administrative fees may be charged for any unjustified dispute or abusive use of the payment system.
11. Resource usage limits Each hosting plan includes defined resource quotas (disk space, bandwidth, CPU, etc.). The Rising Cloud reserves the right to limit, suspend, or charge for excessive usage, even if the plan is advertised as "unlimited," if it affects the stability of the service for other users.
12. Technical support Technical support is offered within reasonable limits and according to the conditions specified in each package. The Rising Cloud is not responsible for the proper functioning of third-party software, scripts, or extensions installed by the client. No guarantee of immediate response is provided outside of business hours.
13. Third-party services Some services provided (domain names, payments, SSL certificates, etc.) are managed by external providers (e.g., Stripe, NameSilo, Let’s Encrypt). The Rising Cloud cannot be held responsible for malfunctions, losses, or delays caused by these providers.
14. Refunds and trials Unless explicitly stated on the product page, no refunds are offered after service activation. Free trials, if offered, are strictly limited to personal, non-abusive use and can be suspended at any time without notice.
15. Personal data The collection and processing of personal data are explained in the Privacy Policy. The client may request access, rectification, or deletion of their data at any time by contacting support.
16. Force majeure The Rising Cloud cannot be held responsible for any failure or delay in fulfilling its obligations in the event of force majeure, such as general failure, natural disaster, fire, cyberattack, war, or interruption of internet services beyond its control. 17. Backups Although automatic backups are implemented (JetBackup), the client is responsible for backing up their own data. The Rising Cloud does not guarantee perfect restoration of all data in case of failure.
18. Prohibited content It is strictly forbidden to use our services to host, store, or distribute illegal, hateful, defamatory, pornographic content, or content violating copyright. Any infringing account will be suspended without notice.
19. Domain-specific conditions Domain names are subject to the policies of the registrar used (e.g., NameSilo). The client is responsible for renewing their domain and the accuracy of their WHOIS information.
20. Modification of terms The Rising Cloud reserves the right to modify these terms at any time. Users will be informed by email or via their client area. Continued use of the service constitutes acceptance of the new terms.
